Impeach or Not?

Do you believe that President Barack Obama should be impeached?  If so, what is your reason?  The calls for impeachment of Barack Obama are coming more often and from different directions.  Calls for impeachment are for a variety of reasons, including Fast and Furious, Benghazi, suing Arizona over the state’s immigration laws, etc.

According to Article II, Section 3 of the U.S. Constitution, “[The President] shall take Care that the Laws be faithfully executed….”  This clause is also known as the Faithful Execution Clause.  This clause of the United States Constitution gives the people the Right to expect their President to administer and execute the laws of the land faithfully.

                W. Cleon Skousen explained, “It is the duty of the President to see that the federal laws are enforced as the supreme law of the land and that anything in the constitutions or laws of the various states to the contrary be subordinated to the federal statutes.  This enforcement may be done through the courts, or, where force is necessary, the President is authorized to call out the militia or the army to restore peace or enforce the law.
“When the President is enforcing the laws of the nation, the judiciary has no authority to intervene….
“In connection with a strike in Chicago during 1895, the court sustained the power of the President to intervene with military force after a court had enjoined the strikers from interfering with the transportation and delivery of the mails.”  (See W. Cleon Skousen, The Making of America – The Substance and Meaning of the Constitution, p. 162.)

For Constitution Day – September 17 – The Heritage Foundation published an article entitled “5 Ways Obama Has Trampled the Constitution” and quoted the above reference in the Constitution.  The five reasons why Heritage believes Obama has trampled the Constitution are:

1) Obama changes the rules for The Patient Protection and Affordable Care Act (Obamacare) whenever he wants to do so even though Presidents do not have the authority to change laws.

2) Even though Congress has not – yet – passed a bill (the Dream Act) to grant amnesty to many illegal aliens, the Obama Department of Homeland Security issued a directive in June 2012 instructing immigration officials to stop deportation proceedings against approximately 1.7 million illegal aliens.

3) Obama made four “recess appointments” in January 2012 while the Senate was still in session in order to fill openings on the National Labor Relations Board (NLRB).  A federal court has ruled that his actions were unconstitutional, but the appointees remain on the board.

4) In July 2012 the Obama Department of Health and Human Services deleted the requirements for work that were part of the 1996 welfare reform law.

5) The Obama Department of Labor instructed defense contractors on November 2, 2012, to not issue notice of layoffs for January 2, 2013, even though the law requires a 60-day notice.  The Administration did not want layoff notices going out only four days before the presidential election.

“One of the Constitution’s strongest features is its simplicity.  It doesn’t serve as a laundry list of rights ….  Instead, it lays out a governing framework, divides power among three co-equal branches, and protects Americans from having their rights usurped by an overreaching government.
“But for the Constitution to survive the next quarter-millennium, we need leaders who are dedicated to maintaining it, not stretching it to suit their immediate political needs.”

It appears to me that Barack Obama is not fulfilling the duties of the office of President of the United States.  I believe that he should be fired, but I do not know if this is grounds for impeachment.

Talk show host Glenn Beck believes Barack Obama committed an impeachable act on September 16 when he “waived a federal provision specifically designed to prevent the U.S. from supplying arms to terrorist groups in order to begin providing military assistance to the Syrian rebels.”

“Today I come to you with the news that our President actually waived the restriction on countries supplying arms to international terrorists, specifically Al-Qaeda.  And the reason why he waived that is because we’re providing arms to international terrorists, specifically Al-Qaeda.  Now, if that isn’t an act of treason, I don’t know what is.  If that is not an act of insanity, I don’t know what is.”
“This isn’t, `Well, we don’t know who the terrorists are.  We don’t know who the rebels are.’  No, no.  Mr. President, you apparently do know exactly who they are because you felt compelled to waive the restriction on arming them.  Now, why would you do that?  So you can no longer make the case `We don’t know who these guys are’ because the President felt compelled to tell us who they are by waiving the restrictions.  They’re international terrorists.  If that’s not an act of suicide, if that’s not an act finally of the President admitting we’re on the wrong side – when you have to waive the law so you can arm terrorists, you’re on the wrong side.”

This is the first time that Glenn has called for impeachment of Obama and here’s why.  “It’s not politics.  It’s not politics.  What do you stand for, America?  If that one doesn’t do it, nothing will.  You are arming people ….  You are empowering them.  This is not, `Hey, I disagree that we have knocked out Al Qaeda,’ which, we did, and obviously that’s true.  Everything the President told you on the run up that we got `Al Qaeda on the run,’ that’s clearly not true now, is it?  Because Al Qaeda is growing in Libya.  Al Qaeda is growing in Egypt.  Al Qaeda is growing, and we’re arming them in Syria.  So if those things you know, you could disagree with.  This one, you’re arming and aiding the enemies of the United States of America.”

According to the Constitution, Article 3, Section 3, and Clause 1:  “Treason against the United States, shall consist only in levying war against them, or in adhering to their Enemies, giving them Aid and Comfort….”  Since Al Qaeda is our enemy, Obama committed treason when he gave them weapons.  I believe Glenn is right in this instance.  I wonder if anyone in the House of Representatives will have the courage to draw up impeachment papers against Obama!
