What Does the Constitution Say about Invasions?

            The topic of discussion for this Constitution Monday is the evasion taking place at the southern border. Article 4 Section 4 of the United States Constitution states: “The United States shall guarantee to every state in this union a republican form of government, and shall protect each of them against invasion….”

            Hordes of immigrants were crossing the border illegally when the Trump administration instituted a policy known as Title 42 in March 2020. This policy relies on a 1944 public health statute to indefinitely close the border to “nonessential” travel. The Biden administration continued the Trump policy to limit the spread of COVID-19.

            The world-wide pandemic has been difficult for all of us as we adjusted to wearing masks and being locked down. We made the adjustments for the good of the nation and to “stop the spread.” Then Joe Biden became the POTUS and the nation started to go downhill. Within days, Biden reversed many Trump policies, but he kept Title 42 in place.

            Now that the worst of the pandemic is over – at least in our hopes – our nation is going back to normal. The border situation is far from normal due to the fact that nearly two million migrants have crossed the border. Although a percentage of the migrants were turned back due to Title 42, more than one million of them are now living in the United States.

            Many more migrants will soon be crossing the border illegally because the Biden administration has ended Title 42 or will soon do so. It was put in place to stop COVID-19 from being carried across the border. Mark Morgan explained the situation this way.

Since its inception in early 2020, T42 has saved countless American lives and reduced untold suffering. Its acknowledged effectiveness is why the Biden administration continued using T42 for over a year, resulting in more than a million illegal aliens – mostly single adults – being denied entry into the U.S.


The U.S. has made tremendous strides in our testing capacity and vaccine availability, something that can’t be said for countries with the highest rate of aliens illegally entering the U.S. from Central America. Haiti has one of the lowest vaccine rates, due to poor infrastructure to distribute the shots, with only 0.94% of people having two does. Jamaica is just at 22% double-vaccination rate. El Salvador, Guatemala, and Honduras all have increased COVID-19 cases per 1 million in population.


In other words, while the Biden administration is telling us we’re nowhere near being past COVID-19, it’s going to end the one authority giving the men and women on the front lines of our nation’s borders the ability to reduce the continuing introduction of the same infectious disease entering the U.S. from countries where cases are increasing and vaccine rates are well below “herd” immunity levels.


Staggering numbers of positive COVID-19 cases have been identified among the illegal alien population this past year. Ending T42 defies logic, common sense, and medical science.

            Not only is the Biden administration dropping T42, but smuggling organizations have also started convincing millions of migrants that there will not be any problem crossing the border. More than 200,000 were expected to cross the border in March with more in the coming months. Paul Ortiz, the Border Patrol chief, admitted that the norm is now 7,000-8,000 apprehensions per day. President Biden is obviously not doing his job to protect the nation from an invasion.
