Can Trump’s Name Be Kept Off 2024 Presidential Ballots?

The topic of discussion for this Constitution Monday is a question about who has the constitutional right to select the President of the United States (POTUS). We know that the federal government does not have this right because it is not delegated to the federal government in the Constitution. Therefore, this right is given to the States or to the People. Since States do not have the right to vote for President, we can assume that only the People have the right to choose a POTUS – through their State representative in the Electoral College.

Numerous States are trying to keep the name of Donald J. Trump off the ballot. A State court in Colorado and a State official in Maine have already removed Trump’s name from their ballot based on the 14th Amendment. The Trump team are appealing both decisions to the Supreme Court. State courts in other States have voted no to removal of Trump’s name from their ballots.

It seems to me that the U.S. Supreme Court has to accept the appealed cases. Legal experts say that the Supreme Court may rule 9-0 in Trump’s favor. If Trump does not win these cases, then anyone can remove any other person’s name from the ballot.

The latest State decision was made by a judge in Wyoming who rejected a motion calling for the removal of Trump’s name from the Wyoming 2024 presidential ballot. Albany County District Court Judge Misha Westby handed down a ruling on Thursday, deciding the case was “dismissed without prejudice” – meaning that the case can be later refiled.

Trump is the candidate most likely to represent the Republican Party in the 2024 presidential campaign facing off with Joe Biden. Trump’s accomplishments in his administration to Biden’s accomplishments in his administration will be on the ballot. Any truly honest person will admit that America and the world were safer and more prosperous during the Trump years. If Biden wins in 2024, we are looking at the demise of America unless God steps in and saves Americans from themselves.
