Constitutional Mandate to Enforce Law

The topic of discussion for this Constitution Monday concerns Article II Section 3 of the United States Constitution. This section lists several duties of the President of the United States. “He shall … take Care that the Laws be faithfully executed….” The President, in other words, has a constitutional mandate to enforce the laws.

There is a current immigration statute that is not being enforced, probably because Democrats want votes and Republicans in Name Only (RINOs) want cheap labor. The President should see that this statute is “faithfully executed.” It is 2013 US Code regarding the unlawful employment of aliens.

            Unlawful employment of aliens - 8 U.S.C. § 1324a (2013)
§1324a. Unlawful employment of aliens

 (a) Making employment of unauthorized aliens unlawful

            (1) In general
It is unlawful for a person or other entity—

                        (A) to hire, or to recruit or refer for a fee, for employment in the United States an alien knowing the alien is an unauthorized alien (as defined in subsection (h)(3) of this section) with respect to such employment, or

(B)(i) to hire for employment in the United States an individual without complying with the requirements of subsection (b) of this section or (ii) if the person or entity is an agricultural association, agricultural employer, or farm labor contractor (as defined in section 1802 of title 29), to hire, or to recruit or refer for a fee, for employment in the United States an individual without complying with the requirements of subsection (b) of this section.

            (2) Continuing employment
It is unlawful for a person or other entity, after hiring an alien for employment in accordance with paragraph (1), to continue to employ the alien in the United States knowing the alien is (or has become) an unauthorized alien with respect to such employment.

There are fines and penalties listed for American employers who hire or continue to employ unauthorized aliens. How many laws are being ignored, and which ones have loop holes that are being used against Americans. If the President chose to enforce this statute, as well as other such statues, it may lessen the flow of undocumented immigrants into our nation.
