This Constitution
Monday finds our nation at a crossroads since the unexpected death of the late
Justice Antonin Scalia. The Democrats,
led by Barack Obama, want to replace him with a liberal, and Republicans want
to replace him with another conservative like him. Conservatives are attempting to preserve the
Constitution in order to protect the freedoms of all Americans.
According to Josh Siegel, the news editor for The Daily Signal, some prior cases could receive another look if Justice Scalia is replaced by a
liberal justice; those cases involve issues “such as race, religion, voting
rights, campaign finance, and the Second Amendment.”
“While it is normal practice for
the Supreme Court to rule again on law it already settled, legal experts say
the outcome of such an effort if a liberal justice replaced Scalia would be
especially dramatic. Indeed, a move from
Scalia, a staunch conservative, to a liberal would be the largest ideological
shift in the court since 1991, when Thurgood Marshall retired and was replaced
by Justice Clarence Thomas.”
Cases that could come up for
retrial could include: (1) District of
Columbia v. Heller (Second Amendment), (2) Citizens United v. Federal Election
Commission (political spending), (3) Shelby County v. Holder (voting rights),
(4) Burwell v. Hobby Lobby (companies forced to provide contraception), (5)
Town of Greece v. Galloway (public prayer), and (6) Glossip v. Gross
(lethal-injection in executions).
